A Calne business has appeared on a list published by the Government today naming employers investigated over National Minimum Wage payments.
The Government has published its latest list of employers following National Minimum Wage investigations carried out by HM Revenue and Customs (HMRC).
The latest announcement names almost 660 employers, with around £4 million being repaid to more than 27,000 workers. Penalties totalling around £7 million have also been issued to employers.
Among those named is Blackland Lakes Limited in Calne.
According to the Government's figures, one worker at the business was underpaid by £4,273.37.
However, the circumstances behind the case are more specific than the figure alone might suggest.
The matter dates back to 2016 and relates to an employment arrangement with an individual worker which included deductions for accommodation.
Blackland Lakes told Calne News that it takes its responsibilities as an employer seriously and is committed to treating its employees fairly and with respect.
The company said it understood the accommodation to form part of the overall package being provided to the employee, and believed that the total value of the package was above the National Minimum Wage.
In its statement, Blackland Lakes said: “The agreement was entered into by both parties in good faith, with the intention of supporting the employee through a difficult period.”
Following a review, HMRC determined that the arrangement did not comply with National Minimum Wage requirements.
The arrears identified by HMRC were subsequently paid to the employee who continues to work there.
Blackland Lakes said the case was an “isolated and historic arrangement involving one employee” and stressed that it was not a deliberate or concealed policy of paying employees below the National Minimum Wage.
The company said: “It was not undertaken for the purpose of reducing staffing costs, avoiding legal obligations or putting its employees at a disadvantage.”
Blackland Lakes also said it regrets that the arrangement did not meet the requirements identified by HMRC and that it promptly took the necessary steps to put the matter right and ensure ongoing compliance.
Blackland Lakes said it remains committed to meeting its legal obligations as an employer and maintaining appropriate employment practices.
The Government's announcement is the latest national enforcement action relating to National Minimum Wage payments. HMRC enforces the minimum wage on behalf of the newly established Fair Work Agency, which took over the wider enforcement role in April.
The Government said the latest naming round is intended to ensure workers receive money they are legally owed and that employers comply with minimum wage rules.
